The Death of the Noncompete?
October 13, 2008 Josh CohenThe California Supreme Court recently affirmed that noncompete agreements are unenforceable against departing employees. The court expressly rejected decisions by the federal 9th Circuit Court of Appeals that allowed enforcement of noncompete agreements if they were narrowly drafted.
Because so many national and international employers do business in California and because California is often on the leading edge of legal and technological development, non-California businesses should take note of the decision.
